Council Meeting Minutes - January 11, 2012


The Council met at 6:30 p.m.

Mr. Wortzman made a motion seconded by Mr. Buczek to go into Executive Session to discuss employment and compensation of personnel.

The Regular Council Meeting was called to order by Mayor Susan Renda at 7:00 p.m.

Also Present: Clerk of Council, Julie Miller, Law Director Margaret Cannon, Village Engineer Jeff Filarski, Police Chief, Tom Flauto and Service Director Ted Dewater.

Mayor Renda introduced Judge Harry Jacob III from Bedford Municipal Court. She gave a brief biography of the Judge. Judge Jacob then gave a brief speech concerning his position and the fact that when he was campaigning he would go door to door to 6,000 homes in the 14 communities that make up the Bedford Court. He stated that a lot of residents in those municipalities, including Moreland Hills, did not know that they are part of the Bedford Municipal Court system. Judge Jacob welcomed residents to come to the court and take a tour.

At this time Judge Jacob swore in Ted Buczek, Daniel Fritz, and Steve Richman as Councilmen, and Mayor Renda as Mayor of Moreland Hills, Ohio.

Mr. Buczek made a motion seconded by Mrs. Cooper to approve the Council meeting minutes of December 14, 2011.

REPORT FROM THE MAYOR

The Mayor stated that she wanted to make a few comments about the last four years that had been spent together with Council and Staff. She stated that there had been a lot of amazing work over the last four years. She stated that the Village had built a new Service Facility that came in on time and on budget. She stated that there had been upgrades to the Police Station. She stated that the Wastewater Treatment Plants were being eliminated, which will save the Village millions of dollars over the long run. She stated that Village was in the process of upgrading and updating building and zoning codes. She stated that there had been increased training for the staff. She stated that a Parks Commission and a Green Commission had been started. She stated that the Village has a very innovative recycling program and that other municipalities had called for advice concerning this. She stated that Forest Ridge had been opened in the last four years and that recently 18 acres had been added to this preserve. She stated that the Village had provided for the Western Reserve Land Conservancy to open their new facility in Moreland Hills. She stated that a Wellness Program had been instituted for the employees of Moreland Hills Village. She stated that the Village had served the residents well and that the feedback was all good. She stated that for the most part, the residents were happy. She stated that she was looking forward to staying positive and optimistic, in the face of the cuts that would ultimately be coming from the State. She stated that the Village was going to have to do more with less, but that the Village had always been good at doing that. She stated that the Village would be looking for creative ways to cut costs without cutting services to the residents. She stated that there had been a survey in the Plain Dealer on Sunday, and that showed that 97% of Moreland Hills residents trusted their government. She stated that this was the highest percentage in the poll. She stated that everyone had a part in this. She stated that she was looking forward to working with each and every one of the Council and staff and serving the next four years.


APPOINTMENTS AND CONFIRMATIONS

Mayor Renda stated that there were several appointments and confirmations to be made.

Mrs. Cooper made a motion seconded by Mr. Richman to confirm the appointment by the Mayor of Peter Bolek to Planning Commission for a term of six years to commence January 1, 2012.

Mr. Richman made a motion seconded by Mr. Wortzman to confirm the appointment by the Mayor of Paul Stanard to Planning Commission to replace Grant Wilk, for a term of four years to commence January 1, 2012.

Ordinances and Resolutions

Ordinance 2012-01 providing for the employment of Santo T. Incorvaia as Prosecutor, fixing compensation and declaring an emergency was introduced by Ms. Sturgis.

Ms. Sturgis stated that the prosecution thus far has been superb.

Ms. Sturgis made a motion seconded by Mr. Buczek to suspend the rules for Ordinance 2012-01.

Ordinance 2012-02 confirming the appointment by the Mayor of the Village of Moreland Hills of Julie Miller as Clerk of Council for a term beginning on October 25, 2011 and ending on December 31, 2012 and declaring an emergency was introduced by Mr. Buczek.

Mr. Buczek stated that the minutes were always the best he had ever seen, and that Julie Miller was always personable, available and approachable when needed.

Mr. Buczek made a motion seconded by Mrs. Cooper to suspend the rules for Ordinance 2012-02.

Mr. Richman stated that he wanted to echo the comments of Mr. Buczek. He stated that the minutes are not easy to do.

Ordinance 2012-03 authorizing the Mayor to sell, dispose of, or recycle obsolete equipment that is no longer needed for Village operations, and declaring an emergency was introduced by Mr. Fritz.

Mr. Fritz stated that the ordinance contained 8 specific items and 1 item that contained miscellaneous items.

Ordinance 2012-04 authorizing the Mayor to enter into an agreement with Ice Miller, LLP, from January 1, 2012 through the January 2014 Organizational meeting and declaring an emergency was introduced by Ms. Sturgis.

Ms. Sturgis stated that this was a continued relationship and that the name had been changed due to a merger that took place on January 1, 2012 with SZD and Ice Miller. She stated that the legal counsel from the firm had been very good during the past years.

Ms. Sturgis made a motion seconded by Mr. Buczek to suspend the rules for Ordinance 2012-04.

Ms. Sturgis made a motion seconded by Mrs. Cooper for passage of Ordinance 2012-04.

Mr. Richman stated that the legal work that he had seen from the firm was some of the best legal work that he had ever seen.

Mayor Renda stated that she felt the Village was well-served with this firm.

Ordinance 2012-05 providing for the employment of Chagrin Valley Engineering, Ltd., and Jeffrey J. Filarski as Engineer for the Village of Moreland Hills, and declaring an emergency was introduced by Mr. Buczek.

Mr. Buczek stated that as a fellow Engineer, he was very impressed with the work Mr. Filarski and CVE provided. He stated that this had been a twelve year relationship thus far. He stated that he commended Mr. Filarski especially for the work that had been done in the past year.

Ordinance 2012-06 amending existing Section 121.01, Council Rules of Chapter 121 of the Codified Ordinances of the Village of Moreland Hills to provide for the standing committees of Council and attendance at committee meetings and declaring an emergency was introduced by Mr. Richman.

Mr. Richman stated that this had been discussed at the Organizational meeting. He stated that the restructuring of committees was to make the meetings more efficient. He stated that the attendance section would allow for removal of a member from a committee or commission if they missed more than three meetings.

Mr. Richman made a motion seconded by Mr. Buczek for passage of Ordinance 2012-06.

Mr. Fritz stated that there were two lines that repeated themselves on the first page. Mrs. Cooper stated that under D, the 4th line down should read Organizational not Organization. Mrs. Cannon stated that these two items would be rewritten and a copy sent to the clerk with the amendments.

Mr. Richman stated that he had appointed the following:

Facilities Committee: Chair: Ted Buczek, Council Member, Steve Richman.

Roads and Safety Committee: Chair: Monica Sturgis, Council Member Bill Wortman.

Mr. Wortzman made a motion seconded by Mr. Buczek to confirm the appointments made by Mr. Richman as Council President.

Resolution 2012-07 supporting the Forest Ridge Expansion Project, authorizing the Mayor to file an application with the Ohio Department of Natural Resources for the Natureworks Program and declaring an emergency was introduced by Mayor Renda and Mr. Fritz.

Mayor Renda stated that this was a grant that had been applied for last year, and that the funds were not granted. In order to apply again this year, the Resolution had to be from the current year.

MISCELLANEOUS BUSINESS

Mr. Richman stated that the meeting days and times for the Facilities and Roads and Safety needed to be set. Mayor Renda stated that she had a preference to have the meetings on the same day as the Planning Commission meeting, so that Staff had only one day of meetings. It was agreed upon that the fourth Monday of the month would be the day and that the Roads and Safety Committee would meet at 7:30 a.m. and that the Facilities Committee would meet at 8:15 a.m. or immediately after the Roads and Safety Committee was finished.

Mr. Buczek made a motion seconded by Mr. Richman to adjourn the meeting at 8:05 p.m.
