Planning Commission Meeting Minutes - January 27, 2014


The meeting was called to order by Chairman Fritz at 6:00 p.m.

Mr. Fritz welcomed Melanie Corcoran as the new community representative on the Planning Commission. He also welcomed former Councilwoman Robin Cooper who is also a new community representative on the Planning Commission as well as Mr. Paul Stanard who is now on the Planning Commission as a Council member representative.

Mrs. Cooper made a motion seconded by Mayor Renda to approve the minutes of the November 25, 2013 meeting.

Pavlos Pavlidis
3660 Chagrin River Road
Erosion Control – Conditional Use Certificate

Chairman Fritz declared the public hearing open at 6:02p.m. At this time, Mrs. Lane administered the oath to those who wanted to speak at the hearing.

Mr. Pavlos Pavlidis, homeowner, was present at the meeting. He stated that he is the new owner of the residence at 3660 Chagrin River Road and is currently in the renovation process. Part of that process is to make some repairs to the stream and to slightly change the contours of the property itself. Mr. Filarski, Village Engineer summarized the project; he stated that there are 3 areas impacted by the stream. The upstream end behind the house used to have an oxbow. They have since filled in the oxbow and straightened out the stream in order to prevent erosion near the house. The second area is by the driveway. There is a culvert that goes under the drive, which is near septic tanks. The culvert pipe was extended and fill and sandstone were put in to protect the stream banks. The third area is a second 48 inch culvert near Chagrin River Road at the second drive crossing where stream bank lining and sandstone were installed. Mr. Filarski stated that it is his understanding that they plan to do a fourth area. Mr. Pavlidis stated that was correct and the area runs along the north side of the home and ultimately ends up under Chagrin River Road after several 90 degree turns, which have ultimately eroded the property. This area is near the northern driveway entrance where several trees are almost falling into the stream at that location. He stated that the house had been vacant for years and therefore the erosion issues were never addressed. The reason the culvert pipe near the driveway was extended was because part of the driveway was falling into the stream.

Mr. Fritz stated that Mr. Pavlidis made a number of cases for why the Village has very specific Ordinances pertaining to this type of work such as the sensitivity of the trees and erosion that he has mentioned specifically in the Hillside and Riparian Setback zones. Those are two areas that are taken very seriously and a tight rein is required on the permitting and plan process for administering that Code because of the fragility in those areas. He stated that unfortunately Mr. Pavlidis did not take that route and as Chair of the Commission, that is something he does not like to see. Mr. Fritz stated that while he sympathizes with the issues Mr. Pavlidis is facing, he hopes that Mr. Pavlidis can sympathize with the degree of severity that the Commission looks at when the permitting process is completely by-passed and work is performed without going through that process. Mr. Pavlidis stated that he understands that. He stated that he personally apologizes for that and informed the Commission that the person that was originally controlling his project is no longer controlling it. Mr. Pavlidis stated that he is following the proper steps at this point and wishes that he had been following the proper steps from the beginning of this project. He stated that he has also submitted the application to the Army Corps of Engineers.

Chairman Fritz declared the public hearing closed at 6:10p.m.

Mr. Cooper asked Mr. Filarski if the work that has already been done has been done properly. Mr. Filarski stated that it appears to be, however, he does have a few questions to ask Mr. Pavlidis’s Engineer regarding the placement of the stone along the channel. He stated that he just wants to ensure that it will be there for a long time.

Mr. Fritz made a motion seconded by Mrs. Cooper to recommend to Council, the conditional use request for erosion control at 3660 Chagrin River Road, contingent upon addressing the comments from the Village Engineer and upon the Village’s receipt of the Army Corps of Engineer’s approval.

Pavlos Pavlidis
3660 Chagrin River Road
Addition/Alteration

Mr. Pavlos Pavlidis, homeowner, was present at the meeting. He stated that he obtained a permit in July or August for interior renovations, which included work to repair structural problems. Mr. Pavlidis stated that he did some demo work on the inside to determine the extent of the structural concerns. It was determined that it was to his advantage to tear down all the drywall in the house because the structural problems were not point loads, as originally thought. He stated that the home has been re-built from the inside out; consisting of doubling floor joists, installing 8 steel beams, and 21 steel columns. At this point, the framing is 90% complete; the weather has currently stalled the progress. The roof framing is almost complete as well, however, the house is now structurally sound at this point. Mr. Pavlidis stated that he is requesting approval for the full permit, minus the electrical work since he will be submitting those plans to Mr. Strichko in the near future. He stated he is also renovating the outside of the house which will entail a new façade since most of the cedar siding is rotted, and replacing the portico and back family room roof. Planters are being proposed for the outside of the house that will step with the grading of the house in order to prevent the rotting of the siding since the siding will terminate where the sill plate sits. The two additions are for the installation of a hydraulic elevator and the expansion of the existing in-law suite. The addition for the elevator is 6 x 18 so that it matches with the roof lines. Mr. Strichko stated that the Village Architect made a note about maintaining fire separation (5/8 Type X) for the in-law suite and to maintain the 4 inch spacing on the stair risers.

Mrs. Cooper made a motion seconded by Mr. Stanard to approve the addition/alteration located at 3660 Chagrin River Road, subject to adherence to all notes from the Village Architect.

Robert Yui

Lot Split

Mr. Robert Yui, property owner, was present at the meeting. He stated that he bought the property from the Village with the plan to eventually build a retirement home on it. In order to do that, a lot split would be required so that the house can be put on the east side, where the land is higher. Mr. Yui stated that he is basically flipping the original 5.4 acre configuration. Mr. Fritz stated that all setback requirements are met for both of the proposed lots. He stated that there was an easement on the southerly end of Parcel 1, for sanitary sewer which would service Parcel 2. Mrs. Cooper asked about the setback requirements for the corner lot based on the new zoning code requirements. Mr. Filarski explained that Mr. Yui’s corner lot was configured a little different (a deep lot that backs a narrower lot) and so it does not fit those normal corner lot setback requirements that Mrs. Cooper is referring to. Mr. Stanard asked if this was expected when the Village put the property up for sale. Mayor Renda stated that it was and that Mr. Yui is just improving on the original lot split in order to make the lot more buildable.

Mr. Stanard made a motion seconded by Mrs. Cooper to approve the lot split located at PP#911-12-005 on the corner of Hiram Trail and SOM Center Road.

Mr. & Mrs. Gene Lapidus
180 Aspenwood
Addition

Mr. Mike Ranney, with Eggert Construction Company, and Mrs. Patricia Lapidus, homeowner, were present at the meeting. Mr. Ranney stated that the Lapidus’ are proposing to update the ranch-style home which was built in the 1960’s. The 300 square foot addition will be in the back corner of the house which will extend the kitchen and family room backward in order to make them a little larger. Mr. Ranney stated that he is still working on the interior layout details and will get the electrical drawings to Mr. Strichko once they are complete. Mr. Strichko stated that the Village Architect made some notes regarding the insulation and the vapor barrier. He stated that all setback requirements have been met.

Mayor Renda made a motion seconded by Mr. Stanard to approve the addition located at 180 Aspenwood, subject to adherence to all notes from the Village Architect.

Bodas Residence
50 Farmcote Drive
New Dwelling

Mrs. Alina Bodas and Mr. Prasad Bodas, homeowners, and Mr. Brendan Grady, Architect, were present at the meeting. Mr. Fritz notified the Commission that Mr. & Mrs. Bodas came before the board previously for a new dwelling which would have required a variance. He stated that more detail and thought have been put into this plan and a variance will no longer be required. Mr. Grady stated that Mr. & Mrs. Bodas are proposing to remove the existing house and build a new one. The new dwelling will be a flat-roofed two-story house with a partially finished basement, 3 bedrooms, and an attached garage. Mr. Strichko stated that they are using he existing driveway and all setback requirements have been met. Mr. Fritz stated that the Village Architect noted that the garage is required to have the proper fire rated drywall and also he recommended two drains on the terrace and a scupper at each roof section. Mr. Stanard asked if a site plan has been submitted yet. Mr. Filarski stated that it has not and the approval can be contingent upon receipt of the site plan. Mrs. Bodas stated that the site plan is in the process of being drawn up currently. Mr. Stanard asked if utilities from the existing house are going to be re-utilized. Mr. Grady stated that everything but the electrical will be; the electrical is currently overhead and they will be taking it to the pole on the property and burying it back to the house.

Mrs. Cooper made a motion seconded Mr. Stanard to approve the new dwelling located at 50 Farmcote Drive, subject to adherence to all notes from the Village Architect and contingent upon submittal and approval of the site plan.

Pergola

Mr. George Clemens with George Clemens Architecture was present at the meeting. He stated that this is a new house built 4 years ago and the pergola was actually planned for at that time. There is an existing deck that has posts laid out for the pergola already. The posts are painted and the beams will be solid cedar or redwood. Mr. Fritz asked if the beams under the deck can carry the load. Mr. Strichko stated that it is really a very minimal load because it is more of an aesthetic feature. He stated that there were no notes from the Village Architect.

Mr. Fritz made a motion seconded by Mayor Renda to approve the pergola located at 150 Miles Road.

David Magnuson
135 Hunting Trail
Addition

Mr. George Clemens with George Clemens Architecture was present at the meeting. He stated that this project is Phase 2 of an addition that was already approved by the Village for a primarily rear facing addition. Upon construction of that addition, Mr. & Mrs. Magnuson were concerned about the appearance of the roof from the front. Mr. Clemens stated that it was decided to add an additional area at the end of the house in order to improve the appearance of the addition from the front and side of the house. He stated that the house has several roof slopes and it is being proposed to match the primary pitch of the house on the main gable. There will be a little bump-out in order to match the 3:12 pitch. Mr. Clemens stated that they wanted a roof that looked like a flat roof, but was not actually flat for maintenance reasons. Mr. Strichko stated that it is not really another roof but is basically there to tie it together to prevent having a “pocket” that will hold snow and ice. He stated that there is one note from the Village Architect to field verify that egress has not been hindered. Mr. Clemens stated that it is an existing master closet and it is just going to be made larger; the egress will not be hindered.
