Council Meeting Minutes - February 11, 2009


The Council Meeting of the Village of Moreland Hills was called to order by Mayor Renda at 7:04 p.m.

PRESENT AT ROLL CALL: Mr. Newman, Mrs. Ovsek, Mr. Richman, Mr. Buczek, Mrs. Cooper.

ALSO PRESENT: Mayor Susan Renda, Law Director Margaret Anne Cannon, Service Director Ted DeWater, Building Commissioner Greg Potts, Engineer Jeff Filarski, Police Chief Tom Flauto and Clerk of Council Mary Catherine Knight.

Mayor Renda introduced Terry Allan, Cuyahoga County Board of Health Commissioner, who gave a power point presentation on Public Health and the services that the Cuyahoga County Board of Health offers. Also representing the Board of Health were Chris Kippes, Director of Epidemiology; Donna Fligiel, Director of Nursing; John McLeod, Director of Environmental Health and Nate McConoughey, Program Manager, Environmental Health.


A motion was made by Mr. Buczek seconded by Mrs. Cooper to approve the Council meeting minutes of January 14, 2009.

REPORTS OF COMMITTEES

Utilities Committee:
Mr. Buczek noted that a few of the items that the committee discussed will be on the agenda. There will be an ordinance for the abandonment of the wastewater treatment plants, authorizing the Village of Moreland Hills to join the Northeast Ohio Regional Sewer District.

Mr. Buczek made a motion seconded by Mr. Richman to advertise for bids for the Jackson Valley Pump Station Force Main project.

Mr. Buczek explained that the EPA regulations have changed. Daily chlorine tests are now required for public water supplies. The Greentree Association has their own public water supply which consists of two wells. They have asked the Village to perform daily chlorine tests. These wells are located adjacent to the Greentree Wastewater Treatment Plant. The tests will be conducted by the Village of Moreland Hills Wastewater personnel and reported by the Village of Chagrin Falls’ licensed water technician.

Mr. Buczek made a motion seconded by Mr. Richman to authorize the Village Service Department Wastewater personnel to conduct chlorine testing of a well, as mandated by the Ohio Environmental Protection Agency, which the well is located on property owned by the Greentree Neighborhood Association and, which serves the residents of Greentree Road, subject to the condition that the Association purchase all necessary supplies and equipment and subject to the Association granting the Village a right-of-entry or license in a form to be approved by the Law Director to permit the Village to conduct the testing.

Mr. Buczek explained that the Village of Moreland Hills has been a member of the Chagrin River Watershed Partners, Inc. for several years and their annual membership dues for 2009 are due.

Mr. Buczek made a motion seconded by Mr. Newman to authorize payment for the Chagrin River Watershed Partners, Inc. dues for 2009 in the amount of $6,490.90.

Service Committee:
Mr. Richman stated that there are some ordinances on the agenda that he will explain when we get to them.

Safety Committee:
Mrs. Cooper said that the Law Department is preparing a bid packet for the police duty room renovations. The Moreland Hills Emergency Guide booklet is at the printers. The Village is looking for more CERT volunteers and they plan to meet this spring. There is an increase in police and fire dispatch service from Chagrin Falls Dispatch. The increase is based on the percentage of calls dispatch makes to the village. Moreland Hills’ increase is about $1000-$1200 additional per month. This amount is also based on the impact of new software and some capital improvement.

Finance Committee:
Mrs. Ovsek reported that the Bills Ordinance, 2009 Budget, and Village Insurance renewal are on the agenda. Everything was discussed and explained at the Finance Committee meeting.

Planning Commission:
Mr. Newman reported that the Planning Commission had a light agenda last month. Mr. Newman asked Planning Commission members to give him their comments regarding a generator ordinance revamp that the Commission will look at next month.

*Ordinance 2009-2 introduced by Mrs. Ovsek. An Ordinance for payment of the bills in the month of February in the amount of $ 580,225.32 and declaring an emergency.

A motion was made by Mrs. Ovsek and seconded by Mr. Buczek to suspend the rules for Ordinance 2009-2.

*Ordinance 2009-23 was introduced by Mr. Buczek. An Ordinance authorizing the Mayor to enter into an agreement for the extension of Northeast Ohio Regional Sewer District service to the Village of Moreland Hills, Ohio and declaring an emergency.

Mr. Buczek explained that this is due to the elimination of the treatment plants.

A motion was made by Mr. Buczek seconded by Mrs. Ovsek to suspend the rules for Ordinance 2009-23.

*Ordinance 2009-24 was introduced by Mr. Richman. An Ordinance amending existing Section 139.01, Position of the Service Director Established; Duties, of Chapter 139 of the Codified Ordinances of the Village of Moreland Hills, to provide that the Service Director is a Full-Time, working position and declaring an emergency.

Mr. Richman explained that this is just correcting and updating existing ordinances.

A motion was made by Mr. Richman seconded by Mrs. Cooper to suspend the rules for Ordinance 2009-24.

*Ordinance 2009-25 was introduced by Mr. Richman. An Ordinance enacting Section 139.04 “Compensatory Time in Lieu of Overtime Pay” of Chapter 139 “Service Department” of the Administration Code of the Village of Moreland Hills and declaring an emergency.

Mr. Richman explained that this has been a policy for years and now will be an ordinance.

A motion was made by Mr. Richman seconded by Mrs. Cooper to suspend the rules for Ordinance 2009-25.

*Ordinance 2009-26 was introduced by Mrs. Cooper. An Ordinance amending existing Section 141.03, Work Period; Overtime, of Chapter 141 of the Codified Ordinances of the Village of Moreland Hills, to limit the amount of accumulated compensatory time and to provide the time period within which such compensatory time must be used and declaring an emergency.

Mrs. Cooper explained that this is in regards to the police department. This has been a policy and now for housekeeping purposes an ordinance.

A motion was made by Mrs. Cooper seconded by Mr. Newman to suspend the rules for Ordinance 2009-26.

*Ordinance 2009-27 was introduced by Mr. Richman. An Ordinance authorizing the Mayor to enter into a contract with Fabrizi Trucking & Paving Company Inc. in an amount not to exceed $764,582.37 for the Chagrin Boulevard Slope Stabilization Project and declaring an emergency.

Mr. Richman noted that this is to stabilize the falling road on Chagrin Boulevard. It will be a wall over 400 feet. The engineer’s estimate was just over 1 million dollars. They will begin in April and finish in June.

Engineer Filarski explained that Fabrizi Trucking & Paving Company Inc. has done projects in the Village previously. They are a large contractor and bid with a good price for the project.


*Ordinance 2009-28 was introduced by Mr. Richman. An Ordinance authorizing a Change Order with Monte Construction, Co., Inc. for the 2008 Drainage Repair Program and declaring an emergency.

Mr. Richman explained that the company hit a headwall that was not seen or known about until they began digging. Therefore, they had to pipe around the headwall.

A motion was made by Mr. Richman seconded by Mr. Buczek to suspend the rules for Ordinance 2009-28.

*Ordinance 2009-29 was introduced by Mayor Renda. An Ordinance to approve and adopt current replacement pages to the Codified Ordinances, and declaring an emergency.

Mayor Renda explained that this is a yearly update and urged Council to update their Codified Ordinance books so that they are current.

A motion was made by Mrs. Ovsek seconded by Mrs. Cooper to suspend the rules for Ordinance 2009-29.

*Ordinance 2009-30 was introduced by Mrs. Ovsek. An Ordinance establishing appropriations for the current expenditures of the Village of Moreland Hills, Ohio for the period ending December 31, 2009, and declaring an emergency.

Mrs. Ovsek explained that this is the 2009 Budget. The Village of Moreland Hills has very healthy reserves, the village spends less than it earns. The Police and Fire levy is up in 2009 which generates a lot of money.

A motion was made by Mrs. Ovsek seconded by Mr. Buczek to suspend the rules for Ordinance 2009-30.

*Ordinance 2009-31 was introduced by Mrs. Ovsek. An Ordinance authorizing the Mayor to enter into an agreement with Wichert Insurance Services Inc., for the provision of General Liability, Police Professional, Public Official, Automobile, and Property Insurance to the Village of Moreland Hills, at the total aggregate cost of $49,800.00, subject to additions and deletions during the term of the agreement as approved by the Mayor; waiving competitive bidding and declaring an emergency.

Mrs. Ovsek stated that Wichert Insurance has provided insurance for the village for over 7 years. The policy this year has an additional 5 million dollar umbrella.

A motion was made by Mrs. Ovsek seconded by Mr. Buczek to suspend the rules for Ordinance 2009-31.

MICELLANEOUS BUSINESS

Mr. Newman stressed the importance of the Police & Fire Levy renewal this year. Mayor Renda said she will appoint a group of residents along with the Chief and Law Director to draft a letter to inform residents of the importance.

Mrs. Ovsek asked Council when the next Ad Hoc meeting could be March 3,6,9,10, or 11? Please check calendars and get back to Mrs. Ovsek.

Mayor Renda noted that Council will be going into Executive Session and no business will take place after.

Mrs. Cooper made a motion seconded by Mrs. Ovsek to enter into Executive Session to discuss employment compensation and personnel issues at 8:20pm.
