BZA Meeting Minutes - March 25, 2013


Chairman Fritz called the Board of Zoning Appeals meeting to order at 5:04pm.

PRESENT AT ROLL CALL: Mrs. Cooper, Mr. Fritz, Mr. Janke, Mayor Renda, Mr. Stanard
ABSENT: Mr. Bolek

OTHERS PRESENT: Greg Potts, Building Inspector, Aimee Lane, Assistant Law Director, Jeff Filarski, Village Engineer

A Motion was made by Mayor Renda seconded by Mrs. Cooper to approve the minutes of the February 25, 2013 meeting.

Sign Variance

Chairman Fritz declared the public hearing open at 5:05pm. At this time, Mrs. Lane administered the oath to those who wanted to speak at the hearing.

Brent LaCount with Design Collective, Inc, and Joe Siccone and Jerry Severin, owners of ML Tavern, were present at the meeting. Mr. LaCount stated that they are requesting a 32.5 sq. ft. variance in order to install a 36 sq. ft. sign. He stated that the proposed sign is revised from the original submittal, which would have required a 61.9 sq. ft. variance.

Since there were no audience members present who wanted to comment, Chairman Fritz declared the public hearing closed at 5:08pm.

Mrs. Cooper stated that she appreciates that the applicant reduced the variance request and stated that she really likes the shape and location of this proposed sign.

Mr. Severin stated that it is important to have identification so that people can read the sign, and he has actually had complaints that Oscar Giovanni’s sign is difficult to read. He stated that the owner of Flour also informed him that he is planning on changing his sign because it is not very visible. Mr. Severin stated that he believes that Mr. LaCount has done a great job reducing the size of the sign while still keeping it visible.

Mr. Janke stated that he is unhappy with the size of the letters “ML” in the sign. He stated that he believes that 37 inch letters are too large for an area that has residential properties on three sides of it. The largest lettering on any of the signs on that building is 25 inches, which he feels is very visible. Mr. Janke stated that he would not be in favor of a variance that included 37 inch letters.

Mr. Fritz stated that work has been put forward to make the sign more acceptable in terms of aesthetics and he feels that there has been some give and take on both sides.

Mrs. Lane stated that ML Tavern being represented by Brent LaCount, is seeking a variance of 32.5 sq. ft. from the signage area requirements of Section 1183.07. The findings in support of granting the variance are:

1. the sign and the readability of the signage proposed is required for the success of the proposed restaurant;
2. the applicant has reduced the amount of variance from the original request;
3. the variance requested is the minimum necessary to make possible the reasonable use of this property for this restaurant;
4. the amount of signage available to this applicant is very limited due to allowable signage area having been shared with multiple, unrelated business at this plaza;
5. the applicant’s predicament cannot be resolved by some means other than a variance;
6. despite notices being sent out to adjacent property owners, no neighbors have come forth with any objections to the request.

Mayor Renda made a motion seconded by Mrs. Cooper to accept the findings of fact.

Mrs. Cooper made a motion seconded by Mayor Renda to approve a 32.5 sq. ft. sign variance for ML Tavern located at 34105 Chagrin Blvd., Unit A.
