Council Meeting Minutes - April 11, 2012


The meeting was called to order at 7:00 p.m. by Mayor Renda.

ROLL CALL: Mr. Fritz, Ms. Sturgis, Mr. Buczek, Mrs. Cooper, Mr. Richman
ABSENT: Mr. Wortzman

Also Present: Mr. DeWater, Service Director, Mr. Filarski, Village Engineer, Chief Flauto, Chief of Police


Mr. Richman made a motion seconded by Mr. Fritz to approve the minutes of March, 2012.

At this time Mayor Renda asked if any resident wished to address Council. Mr. Michael Vogelbaum was present and wished to address Council. He stated that he was planning on installing solar panels on his home. He stated that in December when he approached the Building Department he was told that there was an ordinance in the works that would limit the number of solar panels. He stated that the proposed guideline of 35% of the roof surface was not enough. He stated that the reason he moved to Moreland Hills was the emphasis on green living. He stated that he was striving for energy independence. He stated that much of his system would be in the back of the house. He stated that there would be no panels facing the street. Mayor Renda thanked Mr. Vogelbaum for his input and stated that it would be taken under consideration.

At this time Mayor Renda read a Proclamation to the Chief of Police declaring May 15th Peace Officers Memorial Day and declaring that week National Police Week. Chief Flauto accepted the Proclamation on behalf of all of the fallen officers and the officers doing their duty at this time.


Approval of Bonds, Contracts, Plats, Etc.

Front Setback Variance

Mr. Fritz stated that this was inadvertently left off of the agenda, as Planning had approved the setback variance in February, and the residents had missed the meeting in March. The resident is applying for a front setback variance of 38 feet for the proposed addition to their home.

Mr. Buczek made a motion seconded by Mrs. Cooper to approve the front setback variance of 38 feet, providing that the site plan does not change. If the site plan changes, then the applicant is instructed to come back to Planning with those changes.

Front Yard Variance

Mr. Dennis Bachman, Builder was present to represent the project. The project consists of a shed to help out with storage of lawn equipment. There is a steep slope in the back yard which would prohibit building in the back.

Mrs. Cooper made a motion seconded by Mr. Fritz to approve the Front Yard Variance at 3990 Chagrin River Road.

Front Setback Variance

Mrs. Cooper stated that the owners are asking for a front setback variance not to exceed 13 feet for new construction. Mr. Filarski added that they are trying to stay out of the Riparian setback.

Mrs. Cooper made a motion seconded by Ms. Sturgis to approve the front setback variance not to exceed 13 feet at 255 Springdale Lane.

Reports of Committees

Planning Commission
Mrs. Cooper stated that besides the items that were on the agenda this evening, that Payne and Payne had a spec home that they presented at the Planning Commission meeting to be built in Moreland Mews.

Mrs. Cooper stated that at the last Planning Commission meeting they had met with a resident on Hiram Trail about completion of his renovation project. She stated that he has promised to have the outside of the house completed by the beginning of May.


Facilities
Mr. Buczek reported that the Facilities Committee had met on March 26th. He stated that he had gotten the annual storm water management report. He stated that the Historical Society had moved into the Community Building room. He stated that the Service Director wanted to get started on the hazardous tree removal program early.

Mr. Buczek made a motion seconded by Mr. Richman to authorize the Service Director to develop specifications and advertise for bids for the removal of hazardous trees located on public lands throughout the Village of Moreland Hills.

Mr. Buczek stated that the next meeting was scheduled for April 23rd at 8:00 a.m.


Roads and Safety
Ms. Sturgis made a motion for the Village Engineer to develop specifications and advertise for bids for the 2012 Asphalt program.

Ms. Sturgis made a motion for the Village Engineer to develop specifications and advertise for bids for the 2012 culvert drainage program.

Ordinances and Resolutions

Ordinance 2012-21 enacting new titles one, three, five, seven, and eleven of part eleven, Planning and Zoning code of the Codified Ordinances of the Village of Moreland Hills, repealing existing titles one, three, and five of part eleven, Planning and Zoning code was introduced by Mrs. Cooper.

Mrs. Cooper stated that this zoning code review project had been going on for many months. She stated that it did not include map changes, and does not require a presentation to the electors. She stated that the plan was to put it on three readings, and to recommend it to Planning for their April meeting.

Mrs. Cooper made a motion seconded by Mr. Richman to put Ordinance 2012-21 on first reading and refer it to Planning Commission.

Ordinance 2012-22 providing additional appropriations, transferring items already appropriated and declaring an emergency was introduced by Mr. Fritz.

Mr. Fritz stated that this was a monthly housekeeping item. Mr. Fritz made a motion seconded by Mrs. Cooper to suspend the rules for Ordinance 2012-22.

Ordinance 2012-23 authorizing the Mayor to purchase a 2012 Dodge Charger vehicle from Greve Chrysler Jeep Dodge through the State of Ohio Department of Administrative Services Cooperative Purchasing Program; waiving competitive bidding and declaring an emergency was introduced by Ms. Sturgis.

Ms. Sturgis stated that there were two vehicles which were evaluated by the Village mechanic, and that one was recommended for replacement. Mrs. Cooper asked if this vehicle was replacing the Crown Victoria. Chief Flauto answered, yes it was.

Ms. Sturgis made a motion seconded by Mr. Buczek to suspend the rules for Ordinance 2012-23.

Miscellaneous Business

Mr. Richman asked if the committees could get their minutes out the Friday before the Council meeting.

Mayor Renda stated that Greening the Hills would take place on May the 5th from 9-12. She stated that the Garlic Mustard Pull would be held May 19th from 9-11 a.m. She stated that people should meet in the Forest Ridge parking lot.

Mayor Renda stated that Mr. Jerry Severn had talked to her about a lot that he may want to develop. It was suggested in the Comprehensive Land Use Plan that this property be zoned commercial but the previous owner objected. Mr. Severn would like it to be zoned commercial at this time. Mayor Renda stated that she explained to him that he could either collect signatures or go before Council. Mayor Renda asked Council to please consider this.

Mr. Buczek made a motion seconded by Ms. Sturgis to adjourn the meeting at 8:00 p.m.
