Planning Commission Meeting Minutes - May 19, 2014


The meeting was called to order by Chairman Fritz at 6:00 p.m.

PRESENT AT ROLL CALL: Mrs. Cooper, Ms. Corcoran, Mr. Fritz, Mayor Renda, Mr. Stanard
ABSENT: Mr. Bolek

Others Present: Dave Strichko, Building Inspector, Aimee Lane, Assistant Law Director, Jeff Filarski, Village Engineer, Sherri Arrietta, Clerk of Council

Mr. Fritz asked if there were any additions or corrections to last month’s meeting minutes. Mr. Stanard pointed out that on page 3, Mr. Bolek should not have been part of the vote since he had recused himself for that portion of the meeting.

Mrs. Cooper made a motion seconded by Mayor Renda to approve the minutes of the April 28, 2014 meeting, as amended.

Kane Residence
S/L 16 Greentree
New Dwelling

Mr. Justin Kapela, architect, and Mr. Scott Schleider were present at the meeting. Mr. Kapela stated that the applicants are proposing to build a 3700 sq. ft., 2-story Colonial revival home. There is a 12:12 roof pitch on the sides and 9:12 on the front of the house. There will be a traditional front porch entry and a bay window on the main front facing gable. The exterior of the house will consist of vinyl shake style siding with a stone veneer and white trim. Samples of the materials were shown to the Commission members. All setbacks have been met. Mr. Fritz stated that the Village Architect made a few minor notes on the plans. Mr. Strichko stated that he had a few notes as well, which were some of the same as the Village Architect’s. He stated that he needed complete details on the deck; footer and beam sizes. Mr. Kapela clarified that there is not a deck, it is a pergola. Ms. Corcoran asked about the setback from the hillside protection zone. Mr. Filarski stated that they are 180-200 ft. away, but that the house will be located at the bottom of the hill. Only 2 trees will need to be removed by the driveway at the street. Mr. Filarski asked if the sanitary connection will be open-cut or bored. Mr. Schleider stated that he is not sure yet but would prefer boring. He stated he will call Dave Wagner at Buckeye, who will perform the work, to find out for sure.

Mayor Renda made a motion seconded by Mrs. Cooper to approve the new dwelling located at S/L 16 Greentree, contingent upon adherence to the Village Architect’s notes and Engineer Approval.

Spencer Residence
35070 Jackson Road
Shed

Mr. George Clemens, architect, was present at the meeting. He stated that the applicant is proposing to build a 456 sq. ft. shed to replace an existing shed that is falling down. The proposed shed will be placed 30 ft. closer to the interior than the existing shed in a clearing in the trees which will give the applicants better access to it as well as the ability to park a car in during the winter. One tree may possibly need to be removed for the placement of the shed. The Village Architect approved the plans as drawn and all setbacks have been met. Mrs. Cooper asked about other accessory buildings on the property. Mr. Clemens stated that this will be the only one.

Mr. Stanard made a motion seconded by Ms. Corcoran to approve the shed located 35070 Jackson Road.

Risman Residence
309 Bentleyville Road
Patio/Pergola/Landscaping

Mr. John Peterson was present at the meeting. He stated that the applicants have an existing concrete patio which will be removed and replaced with a sandstone patio, with a perimeter-seating wall made out of the same stone as the house. Mr. Peterson stated that they are also proposing an L-shaped kitchen area, also faced with the same stone, with a pergola over it. The grill will be connected with an underground gas line. He stated that one tree may need to be removed near the proposed wall location. Mr. Fritz stated that the Village Architect approved the plan with one note regarding the anchoring of posts for the pergola.

Mayor Renda made a motion seconded by Mrs. Cooper to approve the patio, pergola, and landscaping located at 309 Bentleyville Road contingent upon adherence with the Village Architect’s notes.

Swamy Residence
60 Falls Creek Circle
New Dwelling

Mr. Ken Wilkins, architect, and Mr. Terry Ries, landscape architect, were present at the meeting. Mr. Wilkins stated that the applicants are proposing to tear down the existing house on the property and build a new 8,000 sq. ft. house with a 6,000 sq. ft. basement. The applicants currently live next door to this property at 50 Falls Creek Circle. He stated that the style of the house is neo-French Chateau having solid natural tan stone and stucco on the exterior. The windows will be black-trimmed Pella windows and the roof will be a dark gray shake shingle. The roof pitch is 10:12 and the area over the kitchen is 6:12 but it cannot be seen. Mr. Wilkins stated that there will also be a 2-car garage built. Mr. Ries explained the site work that needed to be done. The house will be located 15 ft. above the setback of the slope. The driveway will come out onto Falls Creek Trail. He stated that they will connect to the sewer and water on Falls Creek Trail. Mr. Ries stated that around 24 to 30 trees will need to be removed; however, many of them are not in good shape. Mr. Filarski stated that there is a hillside area depicted on the plan, however, he has not had a chance to review it. Mr. Fritz stated that Mr. Strichko still requires several pieces of information to be submitted and the Village Architect approved the plans with notes.

Mrs. Cooper made a motion seconded by Mr. Stanard to approve the new dwelling located at 60 Falls Creek Circle contingent upon adherence to the Village Architects notes, the Building Inspectors comments, and Engineer review and approval.

Petersen Residence
80 Farwood
Deck

Mr. Lenny Serwatka, Lyndhurst Lumber, was present at the meeting. Mr. Fritz informed the members that the deck does extend into the hillside protected area and will therefore need a zoning certificate. He stated that Mr. Filarski determined, after a visit to the site, that there will be minimal interruption to the hillside. The only interruption to the hillside itself will be the borings for the footers. Mr. Filarski stated that the hillside looks stable. He stated that in cases such as this, we have required the homeowners to sign a release in order to build in the hillside, which releases the Village from any responsibility if there were to be any issues. Mrs. Lane provided a copy of the release to Mr. Serwatka. Mr. Fritz stated that the Village Architect approved the plans as noted; he is requiring definition of the beam sizes. Mr. Serwatka stated that they will be 2 x 10. Ms. Corcoran asked about the footer being located near the tree. Mr. Serwatka stated that the plan is to keep the tree and to try to position the footer so it does not hit a root. Mr. Filarski stated that there are enough roots there so it would not pose a problem either way.

Mrs. Cooper made a motion seconded by Mr. Stanard to approve the deck located at 80 Farwood, contingent upon adherence to the Village Architect’s notes and the receipt of a signed hillside protection zone release form from the homeowners.

Danko Residence

Deck

Mr. George Danko, homeowner, and Mr. William Paukert, carpenter, were present at the meeting. Mr. Danko stated that he is proposing to build a deck and attach it to the existing porch in order to make it larger. Mr. Strichko stated that all the setbacks were met. Mr. Fritz stated that the Village Architect approved the plans as noted; minimum of 2-2×8’s at the longer spans between the posts. Mr. Danko stated that the deck will be over an old well, so he stated he will be putting in an 8ft. support in the middle of the deck.

Ms. Corcoran made a motion seconded by Mrs. Cooper to approve the deck located at 4835 SOM Center Road, contingent upon adherence to the Village Architect’s notes.

Discussion
Mr. Strichko gave an update on the Haas Residence project located at 10 Manderly Lane. Ms. Corcoran was brought up to date on the history of this project. Mr. Strichko stated that while they have been working and making progress, they will not meet the June 10th deadline set forth by this Commission. He stated that they will need an extension, which they will request in writing, for another 30 days which will be July 10th.

Mayor Renda made a motion seconded by Mr. Stanard to extend the deadline for the Haas Residence located at 10 Manderly Lane, until July 10, 2014, contingent upon receipt of a formal written request from the homeowner and/or contractor.

Mr. Fritz asked Mr. Strichko for an update on the status of the garage addition at 15 Park Lane because nothing seems to have been done as of yet. Mr. Strichko stated that he needs to look into that.

Mayor Renda asked about the status of the Zhang residence at 4162 Giles since they were continually changing the design of the house. Mr. Strichko stated that there have been a lot of issues inside and they have also had to deal with two architects passing away as well as their current architect being ill and in the hospital. He stated that it is a big shell inside the house.

Ms. Corcoran asked for an update on the erosion control project on 3660 Chagrin River Road that came before this board in January requesting a conditional use certificate; she stated that he was supposed to come back before this board. Mr. Fritz stated that the applicant was waiting to hear back from the Army Corps. of Engineers. Mr. Strichko clarified that he will not be coming back before the Planning Commission but has to go before Council for the conditional use approval. He stated that the applicant is working on the house, which is allowed, but not on the site because Council’s approval is still required.

Mr. Stanard asked Mayor Renda if she has been receiving complaints about the Sunoco Station. Mayor Renda stated that she is getting some every week which she passes along to the Police and Building Departments. A discussion ensued.
