Special Council Meeting Minutes - October 1, 2014


The Special Council Meeting of the Village of Moreland Hills was called to order by Mayor Renda at 7:00PM.

PRESENT AT ROLL CALL: Mr. Buczek, Mr. Fritz, Mr. Richman, Mr. Stanard, Ms. Sturgis
ABSENT: Mr. Sherck

Mr. Buczek made a motion seconded by Ms. Sturgis to approve the minutes of the last Regular Council Meeting of August 13, 2014, as amended.

Reports from the Mayor & Other Municipal Officials

Pat Thornton, Sixmo Architects – Community Building Project Update
Mr. Thornton stated that while the project has gotten off to a slow start, progress is starting to be made. The interior demolition was completed, in part from the Service Department. The contractor has completed the exterior site prep and the foundations and they have started the masonry on the tower portion. The framing of the tower and the framing for the exterior canopy will begin tomorrow. He stated that while the contractor is behind schedule, they are now making faster progress and should be back on schedule. Mr. Thornton stated that he is also working with the contractor to negotiate some scope changes, but he still feels that the contract end date is able to be met. He stated that they will continue to monitor the contractor and make sure that they stay on task. Mr. Richman asked Mr. Thornton if he anticipates any major scope changes. Mr. Thornton stated that when the upstairs demo was done, the insulation came out of the ceiling so that will need to be re-installed as well as installing insulation in a portion of the ceiling where it never existed, in order to keep the building energy efficient. He stated that they are currently negotiating that portion of the job with the contractors and have received some numbers back from them; however he is still working with them to make those numbers more realistic.

Mayor Renda asked Council if they could forgo their Committee reports tonight in the interest of time since we will be swearing in new officers.


ORDINANCES AND RESOLUTIONS:

Ordinance 2014-57 – Introduced by Mr. Stanard
an ordinance amending section 141.01, “composition,” of the codified ordinances of the village of moreland hills, ohio.

Mr. Stanard stated that this Ordinance allows for a change in the composition of the Police Department, as stated in Section 141.01, to permit the Mayor to make appointments to the patrol officer ranks in anticipation of a promotion in the higher ranks of the Police Department.

Mrs. Cannon pointed out that the ordinance did not include the declaration of an emergency; therefore the motion will need to be amended to include the emergency.

Ordinance 2014-58 – Introduced by Mr. Stanard
an ordinance confirming the appointment by the mayor of the village of moreland hills of jeff canter as a full time patrol officer, and declaring an emergency.

Mr. Stanard stated that upon approval of this ordinance, effective October 1st, Jeff Canter will be appointed as a full time patrol officer with the Village of Moreland Hills.

Mayor Renda stated that she thinks that they are privileged to have Jeff Canter come work for the Village. She stated that he has worked with Mr. Incorvaia in Maple Heights in the past and asked him to say a few words. Mr. Incorvaia stated that Mr. Jeff Canter is an outstanding police officer and the Village is fortunate to have someone of his caliber working here. He will join other outstanding police officers here and will maintain the high quality of service that is expected in Moreland Hills.

At this time, Chief Dale Canter swore in Jeff Canter as Patrol Officer.

Mr. Jeff Canter stated that he is very fortunate to be given this opportunity and is very proud to be able to finish his career serving Moreland Hills.


Ordinance 2014-59 – Introduced by Mr. Stanard
an ordinance creating the position of assistant safety director and confirming the appointment by the mayor of dale canter as assistant safety director for an interim period, and declaring an emergency.

Mr. Stanard stated that this will allow the Village to retain the services of Mr. Dale Canter as Assistant Safety Director through the January 2015 Organizational Meeting. He stated that his services are invaluable and his support and dedication to the Village have been felt among the Police Department, Administration and Council.

At this time, Mayor Renda swore in Dale Canter as Assistant Safety Director.

Mayor Renda stated that she is very grateful for the service that Mr. Canter has already given the Village and for his pledge to continue to help us.


Ordinance 2014-60 – Introduced by Mr. Stanard
an ordinance confirming the appointment by the mayor of the village of moreland hills of kevin m. wyant as police chief, and declaring an emergency.

Mr. Stanard stated that Kevin Wyant has worked with the Village for 25 years; most recently as the Executive Lieutenant. He stated that he believes that Kevin fully understands the law enforcement needs of the Village and the needs and difficulties of the Police Department of the Village of Moreland Hills.

Mr. Stanard made a motion seconded by Ms. Sturgis to suspend the rules for Ordinance 2014-60.

At this time, Mayor Renda swore in Kevin Wyant as Chief of Police.

Chief Kevin Wyant stated that he was not only humbled, but honored to have been selected to be the chief. He stated that Moreland Hills is a great community and he looks forward to moving the department forward and working with the great staff and continuing to provide the professional service that they currently provide.

Mr. Dale Canter stated that he would like to take a moment to say a few words to Chief Wyant. “The Philosopher Plato, many years ago, tried to develop what he thought was a perfect society. And part of that perfect society was creating a force he called The Guardians. The Guardians were the wisest, strongest, and fairest of all the citizens; today we call them Police Officers. You have accepted the job of leading the Police Department. Plato posed this question when he had his perfect society formed, The Guardians will watch over society, but who will watch over The Guardians? In Moreland Hills, I know who is going to watch over The Guardians from now on, it’s going to be you (Chief Wyant). You are going to have to train them, you are going to have to discipline them, you are going to have to negotiate with them, you are going to have to negotiate for them, and you may have to provide a shoulder to cry on sometimes, or a pat on the back or a kick in the butt, if that’s what it takes. But most of all you are going to have to lead them. You have a great group of officers here. I am proud to be part of this department for the time I was here. Finishing my 46 year career, I couldn’t have picked a better place to have finished it. You have that nice shiny new badge, but that’s for your dress uniform. When you’re working out on patrol, I would consider it an honor for you to accept my badge. I liked to know that when I’m retired, my badge is still on the job.”


Ordinance 2014-61 – Introduced by Mr. Buczek
an ordinance authorizing change order no. 2 with eclipse co., llc for the 2014 culvert & drainage program and declaring an emergency.

Mr. Buczek stated that the Change Order is for two changes; resetting the catch basin and re-grading along Chagrin River Road, and re-installing a sewer and re-grading for the Giles Road area. It is in the increase amount of $2,955.78.

an ordinance authorizing the mayor to enter into an agreement with the village of bentleyville for cooperation and cost sharing for the 2014 pavement marking program in the village of moreland hills and the village of bentleyville and declaring an emergency.

Ordinance 2014-63 – Introduced by Mr. Buczek
an ordinance authorizing the mayor to enter into an agreement with cuyahoga county department of public works to participate in the countywide preventive maintenance program and declaring an emergency.

Mr. Filarski stated that “if” they have the money available, the County will reimburse the Village for the equipment rental and material costs to make repairs on county roads, however the funding is not yet in place.

Ordinance 2014-64 – Introduced by Mr. Stanard
an ordinance providing additional appropriations, transferring items already appropriated and declaring an emergency.

Mr. Stanard stated that this is a monthly balancing of accounts and appropriations. Mr. Shah stated that there are two attachments to this ordinance; one for August and one for September; however the one from September has changed. Mr. Shah passed out an updated copy to all the Council members. For the month of August: $40,000 is for the contract with MBIS/CVE for their monthly retainer and the amounts paid to them based on the permits collected, $2,500 is for the engineering study for the NPDES permits, $5,000 for basement flood in Village Hall, $6,500 for concrete installation for Jackson Valley Pump Station, and $1,900 for Forest Ridge Stream Restoration. There are also the usual monthly transfers from the general fund to the various funds that the transfers were made to. For the month of September: $17,000 for vehicle maintenance and diesel fuel; there were some unforeseen vehicle repairs needed ($9,000-$10,000) and the rest of the amount was for diesel fuel, and all other transfers were pretty minimal. Again, the monthly transfers from the general fund are listed at the bottom of the page. Ms. Sturgis asked which trucks were part of the repair for the $17,000. Mr. DeWater stated that the salt truck needed repair and one of the garbage trucks needed a computer controller replaced.

Resolution 2014-65 – Introduced by Mr. Stanard
a resolution accepting the amounts and rates as determined by the budget commission and authorizing the necessary tax levies and certifying them to the county fiscal officer.

Mr. Stanard stated that this is a fiscal maintenance item that is done yearly. The Village needs to declare and certify our tax rates for 2015 and present it to the Cuyahoga County Budget Commission. Mr. Shah further explained that Council adopts a tax budget for the subsequent fiscal year, and based on that, the County determines what the Village’s tax rate for properties in Moreland Hills are going to be. There has not been a change in the tax rate for the past several years.

Miscellaneous
Mr. Richman reminded everyone that the Greening the Hills date has changed to October 25th.

Mr. Fritz stated that he would like reiterate a lot of the sentiment tonight about our Police Department. He stated that working side by side with police officers, he knows firsthand what he would perceive as quality officers, and the Moreland Hills Police Department is chock full of them. Mr. Fritz stated that he heard compliments from numerous neighbors after several officers attended his neighborhood’s clambake. He stated that he is very proud of our Police Department.

The Mayor invited everyone to her home for a celebration immediately after the Council Meeting.
