Council Meeting Minutes - October 12, 2011


The Council meeting of the Village of Moreland Hills was called to order by Mayor Renda at 7:00 p.m.

ROLL CALL: Mr. Stanard, Ms. Sturgis, Mr. Wortzman, Mr. Buczek, Mrs. Cooper, Mr. Richman

Also Present: Law Director Margaret Cannon, Village Engineer Jeff Filarski, Building Commissioner Greg Potts, Lieutenant Kevin Wyant and Service Director Ted Dewater.


Mr. Buczek made a motion seconded by Mr. Richman to approve the minutes of September 14, 2011.

Report from the Mayor

Mayor Renda informed Council that County Regionalism Director, Ed Jerse, would answer questions about the Anti-poaching Protocol at the regular November Council meeting on November 9th. She reminded them that D.B. Hartt would present the next Zoning Code update on November 2nd at 7:00 p.m.

She informed Council that the Village received approximately $142,000 in estate taxes this month. The Village submitted a WRRSP grant proposal in the amount of $967,000 on September 16 for stream restoration and land preservation for the Forest Ridge expansion project.


Approval of Bonds, Contracts, Plats, Etc.

A. Mr. and Mrs. Garvey

Lot Split

Building Commissioner, Greg Potts, stated that Mr. and Mrs. Garvey were unable to attend the meeting due to a family matter. Mr. and Mrs. Garvey requested a lot split to avoid a set-back issue with their proposed detached two-car garage. Mrs. Cooper reported that Planning Commission recommended the lot split and both lots meet the 2-acre minimum and set-back requirements.

Mrs. Cooper made a motion seconded by Mr. Richman to approve the lot split at 100 Murwood Drive.

B. Mr. and Mrs. Zhang
4162 Giles Road
Lot Consolidation

Mr. Alpar Koppandi was present on behalf of the Mrs. Zhang. Mrs. Cooper reported that Planning Commission recommended the consolidation of six lots owned by Mrs. Zhang into one.

Mrs. Cooper made a motion seconded by Mr. Buczek to approve the lot consolidation at 4162 Giles Road.


Reports of Committees

Planning Commission:
Mrs. Cooper reported that Planning Commission approved a storage building at the last meeting. They continue to review the rain barrel ordinance. The next Planning Commission meeting will be held on October 24 at 5:00.

Service Committee:
Mr. Stanard reported that the Service Department is preparing its equipment to spread road salt. Furthermore, they have ordered 3300 tons of salt. Due to budgetary constraints the repaving of River Mountain Drive has been postponed until next year. The next Service Committee meeting will be held on October 24 at 4:30.

Safety Committee:
Mr. Richman stated the minutes are self-explanatory. He wanted to point out that the Moreland Hills Police Department is working with about a half-dozen other departments to try to solve the recent spate of burglaries. Residents are encouraged to call the police with any concerns or to report any unusual activities. The next Safety Committee meeting will be held on October 24 at 8:00 am.

Buildings and Grounds:
Mr. Richman stated that this committee did not meet last month. The next meeting has not been set.

Finance:
Ms. Sturgis reported that the Finance Committee convened during the last Committee of the Whole meeting. At that meeting Prashant Shah, Village Treasurer, reported that the Village is in very strong financial condition. Ms. Sturgis pointed out that the Village’s bond rating was upgraded to Aa1. This is the highest rating for any village in the state of Ohio.

Utilities:
Mr. Wortzman reported the Committee discussed the timing of the initiation of the new pump stations. The project will start in December 2011 and is anticipated to end in the second quarter of 2012.


Ordinances and Resolution

Ordinance 2011-10 an Ordinance for the payment of bills in the month of October, in the amount of $358,697.14 and declaring an emergency was introduced by Ms. Sturgis.

Ms. Sturgis stated that a revised copy of the bills ordinance had been provided for Council members. Ms. Sturgis made a motion seconded by Mr. Buczek for suspension of the rules for Ordinance 2011-10.

Ms. Sturgis made a motion seconded by Mr. Buczek for passage of Ordinance 2011-10.

Mr. Stanard questioned the expense for the asbestos removal at Hiram Trail (#41). Mayor Renda explained that this needed to be done prior to demolition of the house. He also asked if the expense for Auburn Pipe (#12) was for labor or materials. Mr. DeWater explained that it was for materials only. Mr. Richman asked about the expense for web site updates (#111). Mayor Renda explained that Strategy Design Partners updates the website monthly and sends out e-blasts for the Village. Mrs. Cooper asked about the Haines Directory (#59). Lt. Wyant explained that it is used by the Police Department on a regular basis.

Ordinance 2011-67 An Ordinance providing additional appropriations, transferring items already appropriated and declaring an emergency was introduced by Ms. Sturgis.

Ms. Sturgis stated that this ordinance is a monthly financial housekeeping item. Ms. Sturgis made a motion seconded by Mr. Stanard for suspension of the rules for Ordinance 2011-67.

Ms. Sturgis made a motion seconded by Mrs. Cooper for passage of Ordinance 2011-67.

Mr. Richman asked about the Equipment Maintenance expenditure. Mr. DeWater explained that the wheel loader sat outside during construction of the Service Facility and repairs to that piece of equipment cost about $17,000.

Ordinance 2011-68 An Ordinance enacting a New Section 131.03, Internet Auctions, of Chapter 131, Mayor, of Title One – Administrative Code of the Codified Ordinances of the Village of Moreland Hills, and declaring an emergency was introduced by Mr. Richman.

Mr. Richman stated that this ordinance would allow the Village to use internet auctions to dispose of unwanted or obsolete items effectively and efficiently.

Mr. Richman made a motion seconded by Mr. Buczek for passage of Ordinance 2011-68.

Mr. Stanard questioned the use of the phrase “non-functioning vehicles” in the ordinance. He was assured that this phrase would not hinder the Village’s ability to dispose of used vehicles.

Ordinance 2011-69 An Ordinance authorizing Change Order No 1 with Specialized Construction, Inc. for the 2011 Asphalt Pavement Maintenance Program and declaring an emergency was introduced by Mr. Stanard.

Mr. Stanard explained that this change order allows for the close out of the project. He stated that the change order amount was less than 3 percent of the total project costs which shows that the original estimate of project costs was very good. Mr. Stanard made a motion seconded by Mr. Buczek for suspension of the rules for Ordinance 2011-69.

Ordinance 2011-70 An Ordinance authorizing the Mayor to enter into a contract with Monte Construction Co., Inc., in an amount not to exceed sixty-three thousand five hundred dollars ($63,500), for the 2011 Culvert Replacement Program and declaring an emergency was introduced by Mr. Stanard.

Mr. Stanard stated that the bid tabulations indicate that Monte Construction was the lowest and best bidder. Mr. Stanard made a motion seconded by Mr. Buczek for suspension of the rules for Ordinance 2011-70.

Mr. Stanard made a motion seconded by Ms. Sturgis for passage of Ordinance 2011-70.

Mr. Richman asked how the culvert repair work is prioritized. Mr. Filarski explained that the Village is trying to be proactive and inspect all culverts to prevent road damage from rotting culverts. Each year the list will be reevaluated and the worst culverts will be replaced or repaired.

Ordinance 2011-71 An Ordinance authorizing the Mayor to enter into a contract with Ake Environmental & Construction Service, Inc., in an amount not to exceed fifty-six thousand one hundred thirty dollars and fifty cents ($56,130.50), for the 2011 Sewer Cleaning and Televising Program and declaring an emergency was introduced by Mr. Stanard.

Mr. Stanard stated that bid tabulations indicate Ake Construction is the lowest and best bidder. He also pointed out that Ake currently performs the Village’s sludge removal for the wastewater treatment plants. Mr. Stanard made a motion seconded by Ms. Sturgis for suspension of the rules for Ordinance 2011-71.

Mr. Stanard made a motion seconded by Mr. Buczek for passage of Ordinance 2011-71.

Mr. Wortzman asked for an explanation of “televising” in this context. Mr. Stanard explained that cameras are inserted into the sewer lines and the resulting images are recorded on a DVD. This allows for assessment of the integrity of the lines.

Miscellaneous Business

Mr. Richman reported that he attended the Chagrin Falls walk to school event and the County Council meeting concerning property reappraisal.

Mr. Charles Lang from the Moreland Hills Police and Employee Foundation reported that donations increased over the past year. The Foundation Open House will be held on December 16.
