Council Meeting Minutes - October 13, 2010


The Council Meeting of the Village of Moreland Hills was called to order by Mayor Susan Renda at 7:10 p.m.

PRESENT AT ROLL CALL: Mr. Buczek, Ms. Cooper, Mr. Richman, Mr. Stanard, Ms. Sturgis, Mr. Wortzman.

ALSO PRESENT: Mayor Susan Renda, Law Director Margaret Cannon, Assistant Law Director Rebecca Schaltenbrand, Village Engineer Jeff Filarski, Building Commissioner Greg Potts, Service Department Director Ted DeWater, and Tricia Ingrassia, Assistant to the Treasurer.


Ms. Cooper made a motion, seconded by Mr. Stanard, to approve the Council Meeting Minutes of September 15, 2010.

REPORTS AND COMMUNICATIONS FROM THE MAYOR

Members of the Recreation Board made a presentation regarding the levy (Issue 10 on the November 2nd ballot). They noted that the renovations are almost complete, and that cooperation among the participating municipalities and the joint funding available through their participation makes for much stronger programming.

The Mayor introduced Ron Janke as the new member of the Planning Commission, and requested that Council confirm his appointment. A motion was made by Ms. Cooper, seconded by Mr. Buczek, that Mr. Janke’s appointment to the Planning Commission to fill the unexpired term of Jackie Rohr be confirmed.

REPORTS OF COMMITTEES

Finance Committee:
Ms. Ingrassia made a report regarding financial information through the third quarter, which is attached. She noted that an additional $97,000.00 in estate tax revenues is anticipated in the fourth quarter, and that the 1989 Street Improvement Bond has now been retired. She reviewed the analysis of changes in expenses and revenues. It was noted that while operating expenses are stable, capital expenses are up significantly because of the major construction projects now underway.

There was a discussion of the mechanism for tracking RITA payments to make sure they go to the correct municipality. It was noted that future financial reports would separate operating from capital expenses.


Safety Committee:
Ms. Sturgis reported that the safety committee met on September 28th. She noted that the Mobile Data Terminals are now in the cruisers; officers can now print reports while they are in their vehicles.

The speed monitoring control box which had previously been located on Jackson Road which was stolen was recovered in unusable condition.

Pursuant to the discussion with the Chief, the Village will participate in the County Forensic Program on a case by case basis since the Village’s need for such forensic services does not justify an ongoing membership.

Ms. Sturgis noted that the CERT team is looking for additional members.

October 23rd through October 31st is Red Ribbon week, in which parents are urged to have conversations about alcohol and drug use/abuse with their children.

The next meeting of the Safety Committee is October 26th at 8:00 a.m.


Building and Grounds:
Mr. Richman reported that the minutes of the September 22nd meeting are self-explanatory. The committee and other members of Council have just completed a tour of the new Service Center Facility. The maintenance and repair facility is anticipated to be completed in two weeks, and the main facility is anticipated to be enclosed in two weeks. The project is ahead of schedule.

The next meeting of the Building and Grounds Committee is October 27th at 8:00 a.m.


Service Committee:
Mr. Stanard reported regarding the Service Committee meeting of September 27th. He noted that the committee has been addressing concerns regarding the “bouldergate” issue; large rocks in the right-of-way which present a potential hazard. The committee has concluded that it is necessary to maintain a 24 inch clear zone from the edge of the pavement for any rocks greater than six inches in diameter. Large rocks are permitted within the 24 inch clear zone only if they guard a mailbox or mark a drive entrance. These requirements will be incorporated into the Village Right-of-Way Ordinance.

Mr. Stanard noted that the Service Director had recommended two clarifications regarding the on site drainage policy and that the retaining wall on Chagrin Boulevard which was damaged can be repaired in-house.

The next meeting of the Service Committee is October 25th at 7:30 a.m.


Planning Committee:
Ms. Cooper reported that the Planning Commission at its last meeting reviewed several requests for accessory buildings pursuant to the new ordinance. There were no variances required for any application for an accessory building.

Ms. Cooper also reported that the Commission had reviewed and recommended approval of a lot split and consolidation plat for the Gillespy property. Mr. Kaprosy was at the Council meeting on Ms. Gillespy’s behalf. He noted that it was found in surveying the property that the drive encroaches one half foot on the adjoining property. In order to eliminate the encroachment, the neighbor has agreed to deed to the Gillespys a parcel of land 45 feet long and 2 feet wide. It was moved by Ms. Cooper, seconded by Mr. Richman, to approve the lot split and consolidation.

Utilities Committee:
Mr. Stanard reported that there had been an investigation of the excessive utility use at the Falls Creek Station, which had led to a recommendation to replace the aging pumps. Installation of the new pumps will enable a downsizing of that facility. Mr. Stanard then gave an update on pending construction projects.

The next meeting of the Utilities Committee is October 25th at 8:00 a.m.


ORDINANCES AND RESOLUTIONS

*Ordinance 2010-10 was introduced by Bill Wortzman. An Ordinance for the payment of the bills in the month of October, in the amount of $1,164,850.50 and declaring an emergency. Mr. Wortzman made a motion to suspend the rules for Ordinance 2010-10. The motion was seconded by Ted Buczek.

A motion to pass Ordinance 2010-10 was then made by Bill Wortzman seconded for adoption by Monica Sturgis.

*Ordinance 2010-67 was introduced by Ted Buczek. An Ordinance for special purpose flood damage reduction for the Village of Moreland Hills, Ohio and declaring an emergency. A motion for third reading and passage of Ordinance 2010-67 was made by Mr. Buczek and was seconded by Paul Stanard.

*Ordinance 2010-72 An Ordinance confirming the appointment by the Mayor of the Village of Moreland Hills of Mary Catherine Peters as Clerk of Council for a term of one year and declaring an emergency. A motion that Ordinance 2010-72 be removed from the agenda was introduced by Paul Stanard and seconded by Robin Cooper.

*Ordinance 2010-75 An Ordinance providing additional appropriations, transferring items already appropriated and declaring an emergency. A motion to suspend the rules for Ordinance 2010-75 was made by Bill Wortzman and was seconded by Robin Cooper.

*Ordinance 2010-76 An Ordinance authorizing the Mayor to enter into a contract with Dalene M. Pride, an independent governmental affairs consultant, to conduct an audit of certain Ohio Bureau of Motor Vehicle records for the years 2009 and 2010 (if necessary) to correct any mis-allocations of motor vehicle registrations to the Village of Chagrin Falls and Chagrin Falls Township and declaring an emergency. A motion to suspend the rules was made by Bill Wortzman and seconded by Steve Richman.
